Later, Louis Vuitton filed an opposition application with the Trademark Office. The Trademark Office decided to approve the registration of the LVMH trademark applied for by Xinyuan Company. The Louis Vuitton company is dissatisfied and applies to the Trade and Industry Commission for a review. The review and adjudication ruling of the TRAB held that the trademarks of Xinyuan Company and the trademarks of Louis Vuitton did not constitute similar trademarks prohibited by the law. The TRAB ruled to reject the application of Louis Vuitton.

Louis Vuitton sued the judges in the court. Louis Vuitton Company believes that the LVMH trademark of Xinyuan Company is the copying and imitation of Louis Vuitton’s well-known trademark, infringing on the company’s previous business right, and in violation of the relevant provisions of the Trademark Law. The company asked the court to cancel the judgment of the Trademark Review and Adjudication Board and ordered the Trade Review Board to make a new decision.
